As of 2026-07-30, sources show that undocumented immigrants were still counted in the census population totals used for apportionment. The administration's proposal to exclude them was announced only in September 2026, after the post, so it does not change the verdict. The claim's referent (illegal immigrants) matches the post, and the extraction is faithful.

This claim is about the present, so it is judged as of the day it was checked.

… Throw up 182 and then 183. These are images of our own border. This is what we lived under Biden. It cannot be overstated, the importance of passing the Save America Act. We know there are hundreds of thousands of illegals on our voter rolls. We know they're getting counted in the census. They must be removed, but they must not be allowed to vote. The American people demand it. It's existential. That's not Spain. That's our own southern border under Biden. …

What we found

Supports. A March 2026 Senate press release from Senators Risch, Crapo and Hagerty states that illegal immigrants are currently counted for congressional district apportionment.[4]

Supports. The Missouri Attorney General's complaint, citing Census Bureau FAQs, says the Bureau's website confirms it will continue to include unauthorized immigrants in resident population counts for the decennial census and apportionment.[5]

Supports. A February 2026 Washington Examiner report says the census has not asked about citizenship since 1950, so both legal noncitizens and undocumented immigrants are included in state population counts used to apportion House seats.[6]

Context. Reuters and AP reporting from September 2026 describes a proposal to exclude immigrants in the U.S. illegally from the 2030 census. That is a future change and does not show they were not being counted on 2026-07-30.[1][2][7]

Context. A 2024 FactCheck.org piece notes that the Constitution's apportionment language is read to include immigrants without legal status in the count.[3]
