The sources show the DOJ opened a case on October 30 into allegations that three Arizona nonprofits registered noncitizens without telling them they were ineligible, but no source establishes that the conduct occurred.

This claim is about the present, so it is judged as of the day it was checked.

What was said

… So, they're on notice of that, but that's additional evidence and information that I need to go get before I bring charges. And, in addition to that, I think a lot of these people are just being misled. We know that they've been, some of them have been registered by NGOs, rights groups that go out to knock on your door and say, do you want to get registered to vote? And they don't tell them that they're not allowed to, you know, vote. And then a couple of them, they went to English for Second Language classes. Um, we're looking into the organizations that were teaching those classes because they offered to sign them up to vote and didn't tell them that they weren't …

What we found

Context. The DOJ's Arizona U.S. Attorney's Office announced it opened a case into 'recent reporting' about three nonprofits registering non-citizens, citing 'written and video reports' and referring the matter to the FBI, but it made no finding that the conduct occurred.[3][5][6][7]

Context. Democracy Docket reports the DOJ letters said the groups 'may have' acted with reckless ignorance, and states that 'the evidence behind these claims do not appear strong'; Axios reports the DNC called the allegations 'fabricated' and said it is not aware of any such registrations.[5][6]

Context. The 'recent reporting' appears to trace to an October 22 video by Muckraker, a right-wing outlet described as having a marred past, which shows a man posing as a felon or noncitizen asking to register.[5]

Context. Authoritative sources state that noncitizen voting is rare and that the broader allegations of widespread noncitizen registration are unsupported, but none of them addresses whether organizations register noncitizens without disclosing ineligibility.[1][2][8]

Context. The ACLU lawsuit and the NYT reporting show the federal government has investigated more than 150 organizations for possibly recruiting noncitizen registrants, which is an investigation rather than a finding of wrongdoing.[4][9]
