The claim says the ERIC contract requires sending non-citizen records but bars citizenship information.

Our two reads of who says this, and how, disagree, so it counts as the post's own claim.

This claim is about the present, so it is judged as of the day it was checked.

What was said

… And as we've talked about many times and is under investigation, the bullshit in the voter rolls is intentional. It's in the design of the system. It's in the contract language of the exchanges between Eric and states that they send non-citizens, but they can't include their citizenship information. And you heard him say just a couple of minutes ago or seconds ago, So thing drags on this guy, I've listened to this once already and I'm sorry to the audience because I know we feel you and we know, but it's important. …

What we found

Contradicts. The DHS letter quotes the ERIC model contract as stating that under no circumstances shall a member transmit a record indicating the individual is a non-citizen, which is the reverse of the claim's requirement to send non-citizen information.[1]

Contradicts. The Heritage report quotes the same membership agreement provision barring transmission of records indicating non-citizenship and notes that the agreement prohibits states from providing citizenship status information, contradicting the claim that the contract requires sending non-citizens.[2]

Context. The DHS letter reports that the ERIC EBU list nonetheless included 30,000 non-citizens in Colorado in 2022, an in-practice outcome that the letter attributes to the data-sharing model rather than to a contract requirement to send non-citizen records.[1]

Context. The ERIC membership-agreement field list and the Wisconsin Legislative Council analysis say the agreement does not currently require citizenship data to be provided, which is consistent with the prohibition on citizenship information in the claim's second half.[3][4]
