What we found

Supports. The Los Angeles Times reports that Justice Department lawyer Robbins said at the October 13 hearing that the government would appeal any disqualification ruling, and that a government request for a stay pending appeal was anticipated.[1]

Supports. The ABC News/AP report says the disqualification order will not take effect until the court rules on the government's motion for a stay pending appeal, which is consistent with an appeal being pursued.[2][3]

Context. The ruling disqualified Essayli from overseeing two criminal prosecutions and found he was unlawfully serving as a 'de facto' U.S. Attorney; Essayli said he disagrees with the order.[1][3]

Context. A separate report says the DOJ has appealed a different California ruling blocking the setting aside of 20,000 ballots; that is a different ruling and does not bear on the Essayli disqualification.[4]
