The sources support the core of the claim: Israel barred defense witnesses who had been Nazis or were otherwise deemed tainted from entering to testify, and withheld immunity, so they could not be heard in court.

What we found

Supports. Hausner stated that all intended defense witnesses were war criminals under the 1950 Nazi and Nazi Collaborators Punishment Law and could not enter Israel without threat of arrest and prosecution.[1]

Supports. The defense could not bring its own witnesses to Israel because the state could not guarantee they would not be charged over past activities, and the defense was unable to bring a single witness.[2]

Supports. The New Yorker reported that Israel was the only country where defense witnesses, having been Nazis, could not be heard, and that the granting or withholding of immunity depended on the government's goodwill.[3]

Context. Sixteen defense witnesses in Germany, Austria and Italy gave testimony abroad, and the court allowed the defense to cross-examine three foreign affidavit witnesses, so tainted witnesses were not excluded entirely from giving evidence.[1][3]

Context. The trial's central prosecution witnesses were survivors testifying in person, and the court's rulings on witnesses are discussed in scholarly and archival accounts, though none of these directly rebuts the exclusion of tainted defense witnesses.[4][5]
