Hur did cite Biden's poor memory as one reason for declining prosecution, since it would make him a sympathetic witness to a jury, so the claim is partly right.

… here, Mike Howell, the president, he's got a way with words, and his summary of a lot of it is like a computer screen that says loading or buffering or something like that. He's just like, can't seem to remember anything, and other times he's entirely lucid. Right, so, you know, Robert Herr concludes that he gets a free pass on violating, taking classified documents with him he was not authorized to take, because of the fact that he had memory problems. I think a lot of that, though, is probably based on the memory problems he was having in 2024. But, you know, as I've been pointing out, the relevant time period actually is not 2024 for assessing whether Biden engaged in, committed a crime, or even 2016 …

What we found

Contradicts. Hur's decision rested on several reasons, not memory alone: Biden's cooperation and the evidence not establishing guilt beyond a reasonable doubt. ABC7 says the decision was primarily because nothing proved willful intent and because of his cooperation.[1][4][5]

Supports. Hur said he declined to prosecute partly because a jury could see Biden as a sympathetic, well-meaning, elderly man with a poor memory, and the report repeatedly cites Biden's limited memory as a factor.[2][3][6][7]

Context. Factcheck.org and PolitiFact note that the memory observations factored into whether a jury could be convinced Biden acted willfully, and that the report did not say Biden was mentally unfit.[2][3]
