A judge did dismiss the case against David Hearn, but not until October 1, 2026, after the September 7 post. Before that, prosecutors (Pirro) dropped the case on July 31, and the post itself says a judge had not yet ruled, so the word "previously" is contradicted by the sources' timeline.

What was said

… A judge today not yet ruling on whether the DOJ's trumped up vandalism charges against Hearn can be tossed out without prejudice, which means they could never be brought again. A judge previously dismissed the case, and U.S. Attorney Janine Pirro admitted the damaged pool liner was due to a botched installation, but she sought to dismiss the case without prejudice, leaving the door open for future litigation. …

What we found

Contradicts. The earlier dismissal was made by prosecutors, not a judge: Pirro dropped the case in a July 31 court filing, and USA Today says the case was dismissed at the U.S. attorney's request. Reuters likewise says the Justice Department dropped its case.[1][4]

Contradicts. As of the September 7 posting, the judge had not yet ruled. Coverage from September 10 and October 1 shows the judicial dismissal came only after the post, so "previously" does not match the record at the time the claim was made.[1][2][3]

Supports. D.C. Superior Court Judge Todd Edelman dismissed David Hearn's Reflecting Pool case with prejudice on October 1, 2026, so a judge did dismiss the case.[2][3][5][6]

Context. Judge Edelman dismissed the case with prejudice, citing political pressure from President Trump, while the government had sought dismissal without prejudice.[3][5][7]
