The sources do not show that Justice Scalia said district judges could not issue nationwide injunctions, and no source covers the specific 2026 USPS mail-ballot injunction the post describes. Coverage of nationwide injunctions names other Justices' separate-opinion views but does not mention a Scalia statement of this kind, so the claim is uncorroborated rather than contradicted.

What was said

… It It's insane how this judge, this judge, what she's doing, in my opinion, he she needs to be investigated for this decision. Yeah, I agree with that, and many such cases, when we're talking about district judges exceeding their authority, and I mean, this person put in a nationwide injunction after Scalia said she couldn't do nationwide injunctions, right? Like, that's that's what we're dealing with, is they they think they're above the law and the precedent and the rules and the standards, and I think Alito crushed it. Thomas joined the dissent. I think that we've we've i understand the timeliness decision. …

What we found

Contradicts. The CRS report says no statute limits nationwide injunctions and no Supreme Court majority has ruled on them, with only several Justices expressing non-binding views. This does not show Scalia said district judges cannot issue them, but it does show no binding rule barred them.[1]

Context. Vladeck's testimony and the Heritage and ABA pieces discuss critics of nationwide injunctions, naming Justices Thomas, Gorsuch, Kavanaugh and Barrett, but none attributes to Scalia a statement that district judges cannot issue them.[2][4][5]

Context. Scalia appears in the sources only in unrelated contexts, such as a dissent in Olson and a discussion of declaratory judgments, neither of which states that district judges cannot issue nationwide injunctions.[3][5]

Context. The sources contain no coverage of the specific district-court injunction in the passage, so the claim that a judge issued it cannot be checked against them.[6]
