Fact-checkers including Snopes, BBC, PolitiFact and AFP found that the claim that Democrats import illegal immigrants to rig congressional elections is unfounded, because noncitizens cannot lawfully vote in federal elections and naturalization takes years.

This claim is about the present, so it is judged as of the day it was checked.

What was said

… They're corrupt. There's voter fraud happening all over the place, and the left doesn't want to lock it down because they believe, with a lot of evidence, that they're the beneficiaries of it. They rig congressional elections by importing illegal aliens by the millions and putting them into blue states so that they can have unearned congressional seats. They rig the Electoral College by doing the same thing. They have unearned Electoral College votes by virtue of illegal aliens pouring into the country. …

What we found

Contradicts. Snopes (Oct 2026) found noncitizens do not vote in large numbers in US elections and treats the Trump-cited claim of noncitizen voting swinging elections as unsupported.[1]

Contradicts. BBC fact-check of Musk's 'importing voters' claim says experts rejected it, noting noncitizens cannot vote in federal elections and citizenship takes many years, and that the claim was rejected by local election officials.[4]

Contradicts. PolitiFact found the social media claim that Democrats voted to make illegal immigrants count toward representation misleading, since the bill at issue concerned census counting and not a vote-importing scheme.[2]

Contradicts. AFP stated that claims Democrats encourage illegal immigration to get a national election advantage are unfounded, since newly arrived migrants cannot vote and citizenship takes at least five years.[5]

Context. The CIS report estimated immigration shifted 17 House seats and a net gain of 14 seats for blue states in the 2020 census, a real apportionment effect, but it concerns census counts rather than importing voters to rig elections.[3]

Context. Third Way's survey of academic research found illegal immigration accounts for between 0 and 1 additional Democratic House seats based on the 2020 census, which undercuts the claimed scale of the effect.[6]

Context. A 2025 PNAS Nexus study examined whether including undocumented residents in apportionment changes party representation, and prior projections were mostly inaccurate; it does not show deliberate rigging.[7]
