Contradicts. The Colorado Bureau of Investigation states that Colorado concealed handgun permits do not meet the exemption criteria, so permit holders must undergo a new background check for every purchase.[1]
Supports. The FBI's NICS licensee manual states that no NICS check is required when a transferee presents a valid state Permit to Carry that ATF has indicated satisfies the Brady permit exception.[2]
Supports. ATF's Brady permit chart says a qualifying state permit can replace the NICS background check, provided it meets three statutory requirements.[3]
Supports. An OJP abstract states that in 26 states ATF has determined a concealed carry permit may exempt the holder from a NICS background check when purchasing a firearm.[4]
Context. Giffords reports that 28 states issue permits or licenses that exempt the holder from the federal background check, and that the ATF determines which permits qualify.[5]
