Literally, the SAVE America Act amendment offered by Sen. Mike Lee got 49 yes votes in the June 4-5 reconciliation vote-a-rama, per a Caplan post and legalclarity.org citing Padilla's office. But the post the claim came from says Lindsey Graham's SAVE amendment got 49 votes, and the record shows Graham's amendment failed 48-50, so that intended reading is contradicted.

A detail. The sources confirm the gist; the verdict faults a detail such as a date, number or wording.

A guest makes this claim. Listeners heard it, so it counts against the post, and on the guest's own record.

What was said

… They deserve the transparency. Go show that you actually are willing to let the process play out, even if you don't have the votes. Stop covering for these cowards and make them put their name on the line. I totally agree with you. Now, the last time we put it for a vote was in reconciliation back in June, I think Lindsey Graham had it as an amendment, and we got 49 votes. We made progress. We made progress. We got 49. We can add more, but again, at the end of the day, it's either got to be a 51 vote. …

What we found

Contradicts. The amendment the post attributes the 49 votes to, offered by Sen. Lindsey Graham, failed 48-50 according to Democracy Docket (via Padilla's office), Yahoo News and NLIHC, so the 49 figure does not match the Graham amendment the speaker described.[1][2][3]

Supports. Legalclarity.org, citing Sen. Padilla's office, reports the Lee amendment on the SAVE Act was defeated 49-50 in the June 4-5 vote-a-rama on the immigration reconciliation package.[4]

Supports. A Craig Caplan post reports the Senate voted 50-49 against Sen. Mike Lee's SAVE America Act amendment to the reconciliation bill, with 60 votes needed.[5]

Context. Sen. Lee's amendment and Sen. Graham's amendment were separate SAVE Act amendments in the same June reconciliation vote-a-rama, and the claim as extracted does not name either senator.[4][5]
